(Bloomberg) -- Enzo Biochem Inc.’s $61 million judgmentagainst Thermo Fisher Scientific Inc.’s Applera unit wasoverturned by a federal appeals court. The technology at issuein the patent case is related to genetic research and screening.
The trial judge in the case erred in interpreting crucialaspects of Enzo’s patent, the U.S. Court of Appeals for theFederal Circuit said in an opinion Monday. The case was returnedto the district court to determine whether Applera infringes thepatent under the revised determination of what it covers.
