July 5 (Bloomberg) -- The idea that the Supreme Court istoo pro-business is rapidly becoming the central liberalcritique of the institution. During last year’s confirmationhearings for Justice Elena Kagan, Democrats made their theme theneed to counter pro-business activism by the conservatives onthe court.

After the court ended its latest term last week, SenateJudiciary Committee Chairman Pat Leahy, a Vermont Democrat, helda hearing on the court’s favoritism toward corporations. Presscoverage has mostly echoed the Democrats. At term’s end, Reutersran the headline, “Big business scores key Supreme Court wins.”
