Hemp-derived THC drinks are poised to be victims of the government spending bill ending the record-long shutdown.

A provision was included into the wide-ranging funding package that would outlaw many hemp-derived intoxicants starting in late 2026, rewriting the federal definition of hemp and closing a loophole that has fueled a fast-growing corner of the beverage market. The package will reopen the US government and finance agencies including the Department of Agriculture and the Food and Drug Administration, which could set rules around the sale of the products.
