Luigi Mangione’s lawyer said federal prosecutors are still weighing the death penalty over the murder of UnitedHealth Group Inc. executive Brian Thompson, complicating his defense on New York state charges over the shooting.

Karen Friedman Agnifilo said at a court hearing Friday that nearly two months have passed and state prosecutors have failed turned over enough evidence for her to adequately respond to both state and federal charges arising from the shocking killing on a Manhattan street late last year. Mangione made his first appearance in state court in Manhattan since a hearing in December after his arrest.
