Billionaire Tim Draper’s proposition to break California into three states won’t be on the ballot in November.

The California Supreme Court said Wednesday the measure, Proposition 9, shouldn’t be on the Nov. 6 ballot because the potential harm in permitting it “outweighs the potential harm in delaying” it to a future election.
