A 23-year-old “Dreamer” will get a chance to fight deportation to Mexico in what would be the first such removal from the U.S. of an immigrant without a criminal record.

U.S. Magistrate Judge James Donahue ruled that the court will hear arguments on whether the Feb. 10 arrest and detention of Daniel Ramirez Medina was constitutional based on U.S. claims that he admitted to being a gang member. Ramirez Medina has twice won permission to stay in the U.S. under President Barack Obama’s so-called Dreamer program, which provides work permits to those brought into the country illegally as children.
