U.S. Aerospace Inc., a California company working with Antonov Co. of Ukraine, lost a protest over the U.S. Air Force’s decision to reject its bid for the $35 billion refueling tanker program.

“This legal decision by GAO’s attorneys concludes that the U.S. Aerospace proposal to build the KC-X tanker was received after the deadline for the receipt of proposals,” Ralph White, managing associate general counsel for the U.S. Government Accountability Office, said today in the statement. “Consequently the Air Force acted appropriately in rejecting the proposal.”
