DuPont Wins Ruling to Pursue Lawsuit Against Bayer

DuPont Co., the third-largest U.S. chemical maker, can pursue claims that a Bayer AG unit violated an agreement to supply a chemical used to make the Require and Resolve corn herbicides, a judge decided.
Delaware Chancery Court Judge Stephen Lamb in Wilmington ruled today that Bayer CropScience LP's lawsuit in state court in North Carolina, challenging a contract requiring it to provide DuPont with isoxadifen ethyl, didn't take precedence over DuPont's claims in Delaware over cancellation of the accord.
