The New York Supreme Court's Appellate Division Upholds Ruling in Sandy-Related Suit Against Zurich American Insurance Co
Jul 10 15
The New York Supreme Court's Appellate Division upheld a June 2014 Supreme Court ruling in a lawsuit against Zurich American Insurance Co. over refusal to pay losses related to Hurricane Sandy. El-Ad 250 West LLC sued the company in August 2013 seeking to recover delay in completion losses of $20 million, saying it could not complete its 250 West high-rise project because of the storm. The appellate court, however, said the $5 million cap mentioned in the insurer's policy document applied to all damages, including delay in completion losses. In June 2014, the state's Supreme Court had granted Zurich American Insurance's motion for partial summary judgment and capped the amount payable for delay in completion losses at $5 million.
