Ashok Leyland Takes Renault-Nissan and Nissan to Court

Ashok Leyland has taken Renault-Nissan Automotive India and Nissan to court, accusing the companies of "arm-twisting" and "criminal breach of trust", while illegally diverting and using plant machinery in violation of government commitments and regulations. In a suit filed before a district court in Kancheepuram, the Hinduja group company has accused its joint venture partner Nissan Motor of taking actions and steps that go against the terms and conditions of their partnership and also in violation of obligations made for import of machinery under the Export Promotion Capital Goods (EPCG) scheme. The two companies had entered into three joint venture agreements in 2008, which included the contentious Ashok Leyland Nissan Vehicles (ALNVL) for manufacture of two utility vehicles -'Evalia' (under Nissan badge) and 'Stile' (under Ashok Leyland). Ashok Leyland held 51% stake in the JV, which imported machinery worth INR 3,340 million under the EPCG scheme. Of this, items worth INR 1,170 million were installed at RNAIPL facility for manufacturing of these vehicles. However, due to a possible unsatisfactory response to the products, a decision was taken in May last year to stop the production of Evalia and Stile, following which the Directorate General of Central Excise Intelligence (DGCEI) raised a due on the JV for payment of duties that were waived off in lieu of the EPCG scheme, Ashok Leyland claimed.
