The Sensitive Data Elon Musk's DOGE Can See — and Can't

Here's where the Elon Musk effort has run into court restrictions — and where it hasn't

Elon Musk’s rapid deployment of the “Department of Government Efficiency” project was quickly met with lawsuits as it spread throughout US agencies seeking access to records and data. Some challengers succeeded in limiting DOGE employees’ access to Americans’ personal and financial information, at least for now, but federal judges declined to immediately intervene at a number of agencies.

President Donald Trump’s Jan. 20 executive order to “maximize governmental efficiency” required every agency to create a DOGE team. Judges have restricted access at three departments to date: Treasury, Education and the Office of Personnel Management. Still, judges who denied requests in other cases expressed concern about what Musk is doing and the lack of transparency.
