Sumner Redstone can’t be questioned by lawyers for his ex-girlfriend until after a ruling on his request to throw out her lawsuit claiming he’s incapacitated, a judge ruled.

The 92-year-old media billionaire, who’s empire includes his control of Viacom Inc. and CBS Corp., was tentatively given a Jan. 27 court date by a Los Angeles state judge for consideration of his request to dismiss the lawsuit by Manuela Herzer. Herzer, who’s been Redstone’s friend for almost 20 years and says she was told to leave his home without being allowed to talk to him, seeks a court ruling that Redstone lacked capacity to revoke a directive for her to make health decisions for him.
