Recording companies suing Sirius XM Radio Inc. scored a victory when a Los Angeles court granted their motion Oct. 14 for a jury instruction stating that the owner of a pre-1972 recording has “the exclusive right to publicly perform, or authorize others to publicly perform, the sound recording” by digital transmission, including by satellite, according to a court filing.
