Tobacco Exhales

Mixed news for cigarette makers fighting an escalating liability war. A Florida circuit court upheld tobacco's claim that the agency that launched the state's Medicaid-cost-recovery law was unconstitutionally chartered. It also limited recovery to costs incurred after the law's July 1, 1994, effectiveness date. But a Minnesota judge allowed plaintiffs' attorneys in other states to review industry documents produced in a suit brought by the state's attorney general.
