Fiscalía Nacional Económica Compañía Manufacturera de Papeles y Cartones and SCA

The Fiscalía Nacional Económica (FNE, the national economic prosecutor's office) has charged two paper manufacturers-Compañía Manufacturera de Papeles y Cartones (CPMC, Chile) and SCA (Sweden)-with running a decade-long price-fixing cartel. On October 28th the FNE filed its case before the Tribunal de Defensa de la Libre Competencia (TDLC, the competition tribunal) against CMPC and SCA, accusing both companies of allocating market quotas and fixing prices. Together the companies control 90% of the local tissue paper market, with sales of approximately USD 400 million per year. The FNE claims that the firms reached an agreement in 2000 to form a cartel that lasted until at least December 2011, affecting the sale of toilet paper, paper towels, paper napkins and tissues. The regulator asked the court to fine SCA USD 15.5 million, although CMPC will not be fined, having admitted to anti-competitiveness practices in March. The case is likely to drag on for years, as a class action suit and a criminal investigation have also been announced. Price-fixing scandals are not new to Chile. Similar cases concerning chicken, prescription drugs and air cargo shipping, among others, have emerged in recent years. The day after the FNE filed the tissue paper case, the Supreme Court upheld a TDLC decision concerning the poultry market collusion case, which ordered the three large producers to pay a total of USD 58 million in fines.

SCA Intends to Close Down Paper Machine at Ortviken Paper Mill

SCA intended to close down a newsprint machine at Ortviken paper mill in Sundsvall, Sweden, and recognize an impairment loss for the mill. Efficiency improvement measures will be implemented at the Obbola and Munksund kraftliner mills. The closure, impairment loss and efficiency improvement measures entail total costs of approximately SEK 1.4 billion and will result in annual cost savings of about SEK 180 million, of which approximately SEK 120 million in lower depreciation, with full impact in 2017. The paper machine that is planned for closure at the end of 2015 has a capacity of 135,000 tons and is the smallest and oldest of the four paper machines at Ortviken paper mill.
