Court Rules against Intellectual Ventures in Case with Capital One

The U.S. Court of Appeals ruled against Intellectual Ventures on July 6, 2015 in a case between the Bellevue company and Capital One. Intellectual Ventures had filed a lawsuit in 2013 in Virginia against Capital One over three patents owned by IV, two of which involve internet-related services and one of which is for photo organization on computers. IV claimed Capital One was infringing on those patents. Judges ruled that the two internet-related patents are 'unpatentable abstract ideas,' and that Capital One was not infringing on the photo organization patent. One of those abstract patents was for "methods of budgeting, particularly methods of tracking and storing information relating to a user's purchases and expenses" online and "methods and systems for providing customized web page content to the user as a function of user-specific information and the user's navigation history". The court had already dismissed this case in 2014, but IV appealed that dismissal. Part of IV's business model is to buy patents and then use them to collect licensing fees from manufacturers that actually build the patented technology. IV has now sued more than 30 companies.
