Mitsubishi Shindoh Files Counterclaim Against Conbraco Industries

Mitsubishi Shindoh has filed a counterclaim against Conbraco Industries, alleging that the company is using a patent lawsuit in an effort to exhaust inventories of the products in question. Conbraco intends to delay this case so that the infringing products will no longer be available at retail stores or from Conbraco by the time discovery formally commences in this action. Mitsubishi said it believes Conbraco will try to exhaust inventories of the infringing products and switch to products that do not infringe the patents, according to the filing. Conbraco Industries in July asked a federal court to rule that it had not violated two patents for copper alloys held by Mitsubishi Shindoh. Conbraco claimed that Mitsubishi Shindoh intended to strengthen its competitive position in the U.S. marketplace through 'intimidation' of Conbraco by alleging infringement of its patents. The company also claimed that Mitsubishi's patents for 'free-cutting copper alloy containing very low lead' and 'copper/zinc alloys having low levels of lead and good machinability' were 'void and unenforceable'. Producers have increasingly adopted brass alloys and pipe with low-lead content as federal regulations restricting the use of lead in pipes have gone into effect over the past few years. Mitsubishi has filed a motion to dismiss the allegations, according to a separate filing.
