Federal Judge Rules Not to Dismiss Class-Action Lawsuit against Chesapeake Energy Corp

A federal judge ruled not to dismiss a class-action lawsuit against Chesapeake Energy Corp. alleging inflated fees passed on to leaseholders. Chesapeake had filed a motion to dismiss the lawsuit, which claims that Chesapeake conspired with then-subsidiary Access Midstream Partners LP to overcharge leaseholders on fees for natural gas gathering in the Marcellus Shale, with Access Midstream rebating a portion of the inflated fees to Chesapeake. U.S. District Judge Malachy Mannion on March 31 ruled that the Suessenbach family's limited partnership may proceed with its lawsuit, as it had already presented sufficient evidence. The lawsuit was filed in June 2014. It seeks damages on counts including unjust enrichment, conversion and racketeering. According to the report, the racketeering count was based on allegations that the companies have been perpetrating an ongoing fraud against leaseholders. There have been other class-action lawsuits alleging racketeering filed against Chesapeake and Access Midstream, among them a pending suit filed by the A&B Campbell Family LLC Trust, also in Pennsylvania.
