High Court Affirms with Appellate Division, Fourth Department Decision in Defamation Lawsuit against The Buffalo News Inc

A Buffalo newspaper was substantially accurate when reporting on a plea agreement involving a firm accused of overcharging the government. The high court on June 27 affirmed the Appellate Division, Fourth Department decision that tossed out a defamation suit by plaintiff Christopher J. Alf against The Buffalo News Inc. Alf, whose attorney was John J. Walsh, of Carter Ledyard & Milburn LLP in New York City, filed suit in 2009 after the newspaper published a series of 2007 and 2008 articles and an editorial related the company’s guilty plea in federal court of making a false statement to settle allegations that it had overcharged the government. The company also agreed to pay the government $28 million in fines and restitution. Neither the company nor Alf was charged criminally. Alf’s complaint said the newspaper’s reporting was 'false and misleading' because it reported prolonged wrongdoing as opposed to the single false statement. The reporting would lead the average reader to conclude that Alf personally engaged in wrongful conduct. Erie County Supreme Court Justice Gerald J. Whalen had granted the defendant’s motion for summary judgment in December 2011. The newspaper was entitled to the defense of absolute privilege under Civil Rights Law 74, which provides that a civil action cannot be maintained for 'the publication of a fair and true report of any judicial proceeding.' The Appellate Division affirmed, although two dissenting justices said statements regarding Alf were 'reasonably susceptible of defamatory connotation'.
