The Pickel Law Firm, Stamford, Wins $495,000 Settlement for Woman, 3 Children Struck by Sears Roebuck Van

After four years of negotiations with Sears Roebuck, The Pickel Law Firm has successfully resolved a lawsuit for a woman whose vehicle was hit broadside by a company van that had driven through a red light. The woman and her three children, who were secured in car seats in the back seat of the vehicle, sustained injuries in the accident when the Sears Roebuck van boned the SUV on the front end and driver's side. The accident, which took place in August 2010, on Woodridge Drive in Stamford, had been scheduled for trial twice and got postponed. The resolution was decided by a panel of three arbitrators who agreed the case was worth $495,000 to the plaintiff, almost ten times the amount initially offered by the defendants. The driver of the van and Sears Roebuck representatives accused my client of being at fault.

The Goodyear Tire & Rubber Co. Sues Sears Roebuck & Co for Backing Out of Joint Deal

The Goodyear Tire & Rubber Co. sued Sears Roebuck & Co. in federal court, seeking $19.5 million in a dispute over the companies agreement to produce co-branded tires for the retail giant. Goodyear accused Sears of backing out of a deal struck in 2009 to produce hundreds of thousands of Weatherhandler tires for Sears. Sears refuses to pay for the tires and won't allow Goodyear to sell them to anyone else.

Sears Holdings Corporation, Through Sears, Roebuck and Co., Sears Development Co., and Kmart Corporation Enter into $400 Million Secured Short-Term Loan

Sears Holdings Corporation, through Sears, Roebuck and Co., Sears Development Co., and Kmart Corporation, entities wholly-owned and controlled, directly or indirectly by the company, entered into a $400 million secured short-term loan with JPP II, LLC and JPP, LLC (together, the lender), entities affiliated with ESL Investments Inc. The first $200 million of the loan was funded at the closing on September 15, and, subject to the satisfaction of certain post-closing conditions, $200 million will be funded on September 30, 2014. The company expects to use the proceeds of the Loan for general corporate purposes. The loan is scheduled to mature on December 31, 2014, but as long as there is no event of default, the maturity date can be extended to February 28, 2015 at the discretion of the company upon the payment of an extension fee equal to 0.5% of the principal amount. The loan will have an annual base interest rate of 5%. The borrowers are required to pay an upfront fee of 1.75% of the full principal amount. The loan is guaranteed by the company and is secured by a first priority lien on 25 real properties owned by the borrowers.
