K+S KALI GmbH Announces Management Changes

The supervisory board of K+S KALI GmbH has appointed Dr. Ralph Jäger a member of the company's Executive Management. As of July 1, 2014, Dr. Jäger will be CFO and Chief Human Resources Officer. His term in office will last until June 30, 2017. Dr. Jäger will succeed Chief Human Resources Officer Steffen Kirchhof who tendered his resignation for personal reasons with effect from June 30, 2014.

K+S KALI GmbH Appoints Alexa Hergenröther as Member of Executive Management

K+S KALI GmbH appointed Alexa Hergenröther as member of the company's Executive Management with effect from 1 June 2014. She will be responsible for marketing and sales. Her term of office will last until 31 May 2019. Alexa Hergenröther (43) will succeed Dr. Ernst Andres, who tendered his resignation by mutual consent with effect from 31 March 2014. Hergenröther was latterly Chief Executive Officer of K+S Chile S.A. She has been with the K+S Group since 2002 and played an important part in the acquisitions of Morton Salt and Potash One. Until her term of office starts, Dr. Ralf Diekmann will serve as acting Head of Marketing and Sales.

K+S KALI GmbH Announces Court Dismisses Action Brought by Gerstungen Municipality

K+S KALI GmbH announced that Gerstungen Municipality has failed in the civil action brought by it to stop the injection of saline wastewater at the Hesse K+S sites belonging to the Werra plant. In a judgment issued on 18 June 2013, the Kassel Administrative Court refused once again to issue an order stopping the practice. Several actions and emergency motions opposing saline wastewater injection filed by Gerstungen were already unsuccessful in the past. With the action brought against the Kassel regional council as the responsible issuing authority, the municipality also wanted the court to rule that the injection permit which already expired in 2011 was illegal. In addition, the regional council was to be obliged to prohibit the practice. Currently, the Werra plant is permitted to inject saline wastewater under a permit of limited duration issued in accordance with water law and set to expire on 30 November 2015. The court did not accept the arguments presented by the municipality. It had no concerns about the legality of the decisions being challenged and rejected the assertion that the potable water supply was at risk because of the injection of saline wastewater into deep layers of rock. In addition, the action contained a series of legal defects in the opinion of the court, with the result that municipality had no right of action. The municipality was ordered to cover the costs of the proceedings.
