Liown Electronics Co. Ltd. announced that it has filed a patent infringement claim against nine defendants for infringing on Liown's U.S. Patent No. 8,926,137, which issued on January 6 and covers Liown's flameless candle technology, Moving Flame TM. Liown has also asserted that these nine companies infringe its U.S. Patent No. 8,789,986. Liown's Moving Flame TM flameless candles started a revolution in LED flames with motion. Liown's patents cover these flameless, electronic candles with a natural simulated flame that dances like real flames. As part of the lawsuit, Liown seeks a preliminary injunction to prohibit Luminara from selling infringing candles. The two-count complaint alleges patent infringement against all 9 corporate defendants, and tortious interference with existing and prospective business relationships against Luminara Worldwide, LLC, Michael O'Shaughnessy, in his capacity as president of Luminara, and John Jacobson, a director-level employee of Luminara. Other defendants are: QVC, Inc., Darice, Inc., Bed Bath & Beyond, Inc., Williams-Sonoma Stores, Inc., Costco Wholesale Corporation, Treasures, Inc., One Kings Lane, Inc., and Brookstone Stores, Inc. As a result of Liown's patents, no other company in the world has the legal right to manufacture, market and sell Liown's patented Moving FlameTM flameless candle technology. HD Buttercup Sues One Kings Lane for Trademark Misuse

HD Buttercup is suing One Kings Lane for trademark infringement, saying the online retailer used its name in Google ads to draw business. In the suit filed in June in U.S. District Court, Central District of California, HD Buttercup alleges the One Kings Lane misappropriated its name and registered trademark in ads posted on Google, attempting to pass itself off as associated with HD Buttercup and siphon off potential Buttercup customers. The suit seeks to stop the e-commerce retailer from further use of its name and seeks unspecified damages and attorneys fees. It s asking for an order requiring One Kings Lane to divulge all information on any gains from its use of the HD Buttercup name. In its complaint, HD Buttercup said One Kings Lane employed Google AdWords to advertise online, noting that advertisers using the program create ads for their goods and services and tie them to certain relevant keywords and phrases they believe consumers will use in their search queries. When a Google searcher uses those keywords, the AdWords program displays the ad above the actual search results. HD Buttercup said it believes One Kings Lane selected the HD Buttercup mark and variations as a keyword relevant to its goods and services. Essentially, that means that a user searching for HD Buttercup would trigger Google s placement of a One Kings Lane advertisement before or above any HD Buttercup search results, it said. It claims that One King s Lane also misappropriated the HD Buttercup marks by inserting them into their actual ads, thereby ensuring that any user searching for HD Buttercup would see and ad labeled HD Buttercup but that was actually created by One Kings Lane. Clicking on the ad would bring the searcher to One Kings Lane.
