National Consumer Law Center Sues Federal Department of Education for Access to Debt-Collector Evaluations
May 19 14
National Consumer Law Center sued the U.S. Department of Education in federal court on May 19, 2014, accusing the agency of improperly refusing to provide access to its evaluations of companies that pursue some unpaid student loan debts. The Consumer Law Center's filing in U.S. District Court for Boston includes copies of emails between the group and the government. In some emails, Consumer Law Center lawyer Persis Yu invokes the federal Freedom of Information Act in asking for copies of performance reviews of debt collectors and other records. E-mails in response show government officials denying some of her requests and responding to others by providing records that are almost entirely redacted. In its complaint, the Consumer Law Center states that public documents indicate debt collectors are paid bonuses and given other incentives for meeting targets.
