Illinois Court Rules in Favour of Kellogg in Kraft Foods Patent Dispute

An Illinois federal court has ruled in favor of Kellogg North America in a lawsuit filed by Intercontinental Great Brands, previously Kraft Foods Global Brands, alleging violation of patented design of resealable cookie packaging. Intercontinental Great Brands had alleged that Kellogg and its affiliates infringed on its patent design, while the latter dismissed such charges. It was alleged that Kellogg's resealable container "was designed to 'circumvent the Kraft patent while maintaining similar properties," helps consumers open a package of cookies then attach plastic flap again to maintain freshness. In a lawsuit filed on 16 January, 2013, it was alleged that Kellogg had used packaging technology for its Keebler and Sandies cookies claimed to be too similar to Kraft's 'Snack 'n Seal' technology. The patent was awarded on July 19, 2005. In its argument, Kellogg submitted that the patent stood invalid since the asserted claims were obvious. The standard of obviousness incorporates four considerations - the scope of prior art, differences between the prior art and the claim at issue, the level of ordinary skill and secondary considerations like commercial success, 'long felt but unsolved needs' and the failure of others to create the art at issue. The court also looked into previous incarnations of resealable packages, such as a 2002 patent for a package that prevents meat and cheese from drying out in a refrigerator and a 2001 system for keeping sushi. It came to the conclusion that claims in Kraft's patent are obvious as machinery updates to the prior art, granted Kellogg's motion for summary judgment and nullified the patent.

Kellogg North America announced unaudited earnings results for the third quarter and nine months ended September 27, 2014. For the quarter, the company reported net sales of $369 million against $382 million a year ago. Operating profit was $58 million against $70 million a year ago. Underlying operating profit was $60 million against $70 million a year ago. Operating profit decreased by 19.8%; underlying internal operating profit declined by 9.1%, as the result of lower sales.
For the nine months, the company reported net sales of $1,111 million against $1,173 million a year ago. Operating profit was $192 million against $223 million a year ago. Underlying operating profit was $203 million against $224 million a year ago.
