MGA Entertainment, Inc. Announces U.S. District Court for the Southern District of New York Granted Summary Judgment in Favor of A Liability Insured

The U.S. District Court for the Southern District of New York granted summary judgment in favor of a liability insured in a declaratory action brought to determine whether liability policies issued by numerous insurers covered an underlying copyright infringement action. The underlying complaint alleged facts giving rise to potential coverage for an advertising injury under the relevant policies. From 1999 through 2007, MGA Entertainment Inc. maintained liability insurance under policies issued by Lexington Insurance Co., National Union Fire Insurance Co. of Pittsburgh, Pa., American International Underwriters Insurance Co. and Chartis Specialty Insurance Co. MGA also maintained liability coverage under a policy issued by Crum & Forster Specialty Insurance Co. (C&F) for the years 2003 through 2005. In 2009, Bernard Belair sued MGA, alleging copyright infringement based on testimony given by an MGA employee in a separate action. The employee acknowledged he was 'inspired' by figures in advertisements produced by Belair in producing a line of toys whose figures had similar large heads, large oval eyes, small bodies and large feet. MGA tendered defense and indemnity of the underlying action to its liability insurers, who disclaimed coverage. A declaratory action followed. The parties then filed cross-motions for summary judgment. Complaint adequately alleged advertising injury. The court held this potential liability included the possibility that MGA would be found liable for damages based on a covered advertising injury. Accordingly, the district court granted MGA's motion for summary judgment in relevant part.
