In response to the complaint, Artel, LLC filed a counterclaim based on allegations of breach of contract and certain business torts. On December 20, 2013, the court entered a judgment against GTT Communications, Inc. in the amount of $3.3 million. The court suspended the judgment, subject to a letter of credit during the appeal to the Supreme Court of Virginia. On October 29, 2014 the Supreme Court of Virginia granted in part and denied in part GTT Communications, Inc.'s petition for appeal and this decision was communicated to GTT Communications, Inc. on October 30, 2014.
