The country's tobacco firms will not have to make an immediate $1 billion payment to Quebec smokers who won a landmark class-action suit. In a ruling on July 23, 2015, the Quebec Court of Appeal said that it could be problematic for the companies to recoup the money if they are eventually successful in appealing a judgment ordering them to pay $15.6 billion. The initial $1.13 billion payment was due this July 26, 2015 after a judge ordered it handed over to smokers within 60 days of his ruling. Imperial Tobacco, Rothmans, Benson & Hedges and JTI-Macdonald have appealed the overall decision that saw a Quebec judge rule that they must fork over the $15.6 billion to smokers who either fell ill or couldn't quit the habit.
Québec Court of Appeal Overturns Trial Court's Order for Payment of Judgment in Tobacco Class Actions Pending Appeal

On July 23, 2015, Quebec Court of Appeal overturned the trial court's order that Rothmans, Benson & Hedges Inc. pay an initial deposit of approximately CAD 246 million into a trust account pending appeal of the Quebec class actions judgment. The trial court had ordered, as part of its judgment, that RBH and the other defendants make initial deposits of a portion of the damages award within 60 days. The Court of Appeal's decision cancels the trial court's order for payment while RBH pursues its appeal of the trial court's decision in its entirety.
Imperial Tobacco, Rothmans Benson & Hedges and JTI-Macdonald to Pay $15 Billion in Damages

Three tobacco companies have been ordered to pay $15 billion in damages after losing a class-action lawsuit. Judge Brian Riorda on June 1, 2015 ruled in favour of two groups representing Quebec smokers, ordering Imperial Tobacco, Rothmans Benson & Hedges and JTI-MacDonald to pay for punitive and moral damages. The legal proceedings began in March 2012, 13 years after the lawsuit was initiated by the two groups comprising about one million people. The lawsuit was seeking $27 billion in damages. One group involves individuals who have become seriously ill from smoking, and members of the other group say they are unable to quit smoking. The groups alleged the companies: ailed to properly warn their customers about the dangers of smoking; Underestimated evidence relating to the harmful effects of tobacco; Engaged in unscrupulous marketing; Destroyed documents. The plaintiffs with cancer who began smoking before January 1976 will get $100,000 each. Those who first lit up after that date are entitled to $90,000. The Court orders the provisional execution of the judgment notwithstanding appeal with respect to the initial deposit of $1 billion of moral damages, plus all punitive damages awarded.
