ArborGen to Pay $81 Million in Compensation and Damages

ArborGen must pay $81 million in compensation and damages after a US court found it used trickery and deceit to defraud workers out of a lucrative incentive package. Nine former employees of seedlings company ArborGen were tricked into accepting a revised long-term incentive plan that cut their combined compensation package by around 90% after the company began to grow, a South Carolina lower court judge found. The lawsuit filed in 2010 against ArborGen alleged that company board members used 'deception, misplaced trust and pressure tactics' to convince employees to join the less valuable incentive plan.

Rubicon Reiterates ArborGen's Listing Plans

Rubicon Limited (NZSE:RBC) reiterated plans for an initial public offer for ArborGen Inc. as it laments its languishing share price. "To be clear, it is not a question of whether ArborGen can be IPO'd - unquestionably it can be," Fletcher said, "Rather it is a matter of choosing the optimal mix of equity market conditions and business progress to execute an IPO of the company - to set an appropriate initial value of the company, at minimum dilution to existing shareholders, and to raise sufficient capital to secure its future growth." "If Rubicon had surplus cash today we would immediately undertake an on-market share buyback programme to correct the situation - it would overwhelmingly be the best use of our cash," Fletcher said, "However at the moment our hands are tied, as we need to preserve all our cash for on-going investment into ArborGen."
