Cartica Management LLC added Itaú Unibanco Holding S.A. and Banco Itau Chile as defendants in its amended complaint against the proposed merger of CorpBanca and Banco Itau Chile. The defendants named in Cartica's April 1 lawsuit - which seeks to enjoin the closing of the proposed transaction - were CorpBanca; its controlling shareholder Alvaro Saieh; CorpBanca's directors, CEO and CFO; and Saieh's holding companies. The amended complaint asserts that Saieh, Itaú and CorpBanca are "continuing to withhold material information, and failing to correct material misstatements" - even after Cartica filed its complaint identifying multiple alleged violations of U.S. securities laws. The case is pending in the U.S. District Court for the Southern District of New York.
