Decision Diagnostics Rejects Settlement Offers from J&J/Lifescan

Decision Diagnostics Corp. announced that despite repeated refusal of Lifescan's mediation overtures, the company was ordered to attend a mandatory, court-directed mediation on January 29, 2015. Following two separate days of these compulsory discussions at the Federal District Court for Northern California (San Francisco), which concluded on February 23, 2015 the company has again rejected Lifescan's settlement offers. The company, more importantly, is announcing that the preparation for an expected explosion of product demand following legal victory has already begun. Solicitations for interview and quotation have been circulated to various internationally certified and FDA approved manufacturers for the contract manufacture of GenStrip™ 50. The time frame for tooling creation, first article part delivery and full product production is expected to fall within a five to seven month timeframe, following the final selection of an international contract manufacturer. Concurrent to the fulfillment of supplemental GenStrip™ 50 manufacturing, that selected manufacturer will simultaneously be charged with the completion of a new product that has been under internal development for nearly a year. Several of these manufacturing candidates are currently manufacturing second generation, FDA cleared, embryonic versions of the company's (3rd generation) product concept.

LifeScan, Inc. has introduced the new OneTouch Verio Blood Glucose Monitoring System that helps people with diabetes better understand their results without any extra effort. Easy to use, the OneTouch Verio System features a color-coded range indicator that shows whether a test result is within, below or above the range limits set in the meter without the need to scroll or push buttons. It also looks for signs of progress and provides positive reinforcement with Progress Notes, which inform patients about the progress they are making in managing their diabetes and how often their blood glucose results are in range. After using the OneTouch Verio Meter for a week, 94% of people with diabetes said it made their test results simple to understand. The low and high range limits set in the OneTouch Verio Meter can be customized for each patient based on their healthcare professional's recommendations. With each test, the color-coded range indicator feature shows whether a result is below limit (blue), within range (green) or above the limit (red). When the meter displays a low result, it prompts the user to treat the low glucose result and retest in 15 minutes. UniStrip Technologies, LLC Sues LifeScan, Inc. for Antitrust Violations

UniStrip Technologies, LLC has filed an antitrust lawsuit in the Los Angeles federal court against LifeScan, Inc. for violations of the Sherman and Clayton Acts. UniStrip alleges in its complaint, LifeScan has taken anti-competitive measures by withholding rebates, cooperative marketing funds, and other incentives from wholesalers and retailers who offer UniStrip1 for sale. LifeScan's attempts to preclude UniStrip's entry into the market were coordinated within the company, executed by sales representatives, and added to contracts that expressly conditioned the payment of rebates for LifeScan products on the distributor's refusal to purchase and sell UniStrip products.
