Kan. Court Upholds Permit for Sunflower Electric Power Corp.'s Coal Plant Expansion

The Kansas Supreme Court has upheld a redone air permit for the 895-MW planned expansion of Sunflower Electric Power Corp.'s Holcomb power plant. In March 17 opinion, the court announced that the Sierra Club "failed to establish a basis for invalidating" a permit issued by the Kansas Department of Health and Environment. The decision is the latest development in the environmental groups' years-long battle against the proposal. The original air permit was issued by state regulators in 2010. The Sierra Club challenged that permit and in 2013, the Kansas Supreme Court ruled in favor of the environmental group and sent the permit back to the Kansas Department of Health and Environment, which issued an addendum to the permit at the end of May 2014. The Sierra Club then challenged that decision, arguing, in part, that the permit did not comply with the U.S. EPA's greenhouse gas rules by failing to set gas emission limits. The group announced the permit would allow the proposed plant to emit 8 million tons of greenhouse gases each year, making it a large single source of greenhouse gas emissions in the state. But the court rejected the Sierra Club's arguments, stating that the group did not show that Kansas regulators erred in adding an addendum to the permit. Sunflower in a statement March 17 announced that it was happy with the court's decision and that much work has gone into making certain that the Holcomb expansion air permit meets all applicable state and federal requirements. If the Holcomb expansion is finally built, Tri-State Generation and Transmission Association Inc. will own a majority of its output. The proposal would come with a nearly $3 billion price tag, making it one of the most expensive coal plants in the country at a time when renewable energy is cheaper and more widely available than ever before.
