Godrej & Boyce Mfg. Co. Ltd. Key Developments

Gujarat High Court Restrains Godrej & Boyce Mfg Co Ltd from Selling 'Diet' ACs

The Gujarat high court restrained Godrej & Boyce Mfg Co Ltd. from marketing and selling its new range of air conditioners using the trademark 'Diet' for six months. The stay was ordered after the Symphony Ltd. claimed infringement on trademark. Justice Ashish Desai temporarily stayed Godrej from marketing and selling its Eon Diet air-conditioners on the basis of an appeal filed by Symphony. The local firm moved the HC after a city civil court rejected its plea to restrain Godrej from selling the air-conditioners with 'Diet' in its name. Symphony had argued before the chamber judge R I Ganeriwal at the city civil court that the word 'Diet' had been registered as a trademark by Achal Bakeri and the company had been given the sole right to use it. Symphony said it had launched its air-coolers under the brand 'Diet' to suggest energy efficiency. However, the civil court judge said that the two companies dealt in different goods. While Symphony makes air-coolers, Godrej manufactures air-conditioners. He said that since the products are different, there was no scope for confusion over the name of the product and Godrej cannot be said to be passing off its products under the trademark belong to Symphony. When the city civil court turned down Symphony's request on April 24 to grant an interim injunction, the local company moved the HC. The HC has directed the lower court to complete hearing of the trademark suit in six months.
