The Pennsylvania attorney general filed legal action against Golden Living for allegedly failing to provide basic services at nursing homes in her state. Its subsidiaries are commonly known as Golden Living Centers, of which 14 are named in the lawsuit. The lawsuit alleges violations of the Unfair Trade Practices and Consumer Protection Law by deceiving consumers through marketing practices. The legal action seeks permanent injunctive relief prohibiting Golden Living from engaging in the allegedly deceptive and unlawful business of which it is accused. In addition, it seeks $1,000 per violation of the law, or up to $3,000 for every violation involving a person 60 years old or older. The action also seeks restitution for consumers, injunctive relief and costs of litigation.

Akin Gump Secures Summary Judgment in a False Claims Act Lawsuit Filed by the United States Against Aegis Therapies and Golden Living

Akin Gump secured summary judgment in a False Claims Act (FCA) lawsuit filed by the United States against Aegis Therapies and Golden Living. The United States had alleged that Aegis knowingly provided medically unnecessary therapy to Medicare Part A beneficiaries residing in a Golden Living SNF because the beneficiaries did not achieve significant improvement. As proof, the government primarily relied upon the testimony of its expert witnesses, who reviewed a sample of records, and then sought FCA damages based upon a statistical extrapolation of the sample. The Akin Gump team showed that the Department of Justice used the wrong health care regulatory standard one that applied to outpatient settings and inpatient rehabilitation facilities, but not to the Medicare Part A SNF residents relevant to the lawsuit to evaluate the health care claims of the defendants.

The clinical and strategic collaboration will utilize naviHealth's decision support technology, post-acute care analytics platform and network of clinicians to enhance patient outcomes and improve the transition of care for patients who desire to return home. The partnership is intended to support the value-focused paradigm shift taking place in reducing the cost of health care while improving the total patient care experience. The companies partnership with Golden Living to deliver comprehensive care management services to its eligible skilled nursing facility providers is hopefully the first of many such alliances the company's can forge to improve the delivery and management of post-acute care across the country.
