American Guarantee & Liability Insurance Co. filed a lawsuit alleging it does not owe coverage for $20 million in punitive damages awarded in an underlying case. According to the lawsuit, American Guarantee provided commercial umbrella liability insurance to The Shelly Co. An Ohio jury found Shelly, a paving company, liable in connection with the death of a man who was hit by a car on an interstate while working in a construction zone. The underlying lawsuit alleged Shelley was negligent in its safety planning. The jury awarded $19 million in compensatory damages and $20 million in punitive damages. American Guarantee alleges that the policy it issued to Shelly does not provide coverage for punitive damages.
