Glancy Binkow & Goldberg LLP Files Class Action Complaint Against Goodman Manufacturing Company. L.P. and Goodman Global, Inc

Glancy Binkow & Goldberg LLP filed a class action complaint in federal court against Goodman Manufacturing Company. L.P. and Goodman Global, Inc. related to the company's alleged defective air conditioning units. Specifically, the complaint alleges that Goodman's air conditioning units contain defective evaporator coils that leak causing the units to stop functioning properly. Consequently, Goodman customers have paid thousands of dollars in repair costs. The complaint alleges that Goodman breached its express warranty and is engaging in unfair and deceptive trade practices in connection with the manufacture and sale of its air conditioning units. On August 28, 2013, the Court issued an Order denying, in part, Goodman's Motion to dismiss the complaint. In that Order, the Court concluded that plaintiff has plausibly alleged that Defendants warranty limitations were unconscionable, and on this basis alone this court will deny the Motion to dismiss as to plaintiff's express warranty claim.

Audet and Partners, LLP Files Class Action Lawsuit Against Goodman Global, Inc

A new class action lawsuit filed in Florida on May 7, 2013, alleges that Goodman and Amana manufactured and sold air conditioner units since 2008 that failed to conform to reasonable consumer expectations based on express product warranties. The Complaint filed in the lawsuit, Helms v. Goodman Global, Inc., et al, United States District Court, Middle District of Florida, Case No. 8:13 CV1213T17TBM, alleges that central air conditioning units sold during this time contain defective evaporator coils prone to premature rupture. The central air conditioning units manufactured and sold during this period by Goodman Manufacturing Company, allegedly contain defective evaporator coils that may have caused units to rupture and leak Freon, often rendering the units unable to cool air. The lawsuit contains allegations that the company knowingly sold defective air conditioning units, hid the problem from consumers, and unfairly denied warranties claims for the defective products. The lead plaintiff in this class action lawsuit, Ms. Janet Helms, alleges that numerous failures of her Amana air conditioning unit required out-of-pocket costs exceeding $9,000 for repairs and ultimate replacement of her unit. Attorney William Audet whose law firm, Audet and Partners, LLP, filed the lawsuit, commented on the allegations raised in the class action complaint.
