Houston Theater Files Antitrust Lawsuit against AMC Entertainment Inc

A Houston movie theater has filed an antitrust lawsuit against AMC Entertainment Inc. alleging the company caused it to go out of business. According to the suit, Viva Cinema created a business plan to tap into Houston's 'unserved' Hispanic demographic. It planned to show first-run films, either with Spanish subtitles or dubbed in Spanish. However, the suit alleges that once AMC learned about Viva Cinema's plans, it threatened seven major Hollywood studios, including Warner Bros., Disney and Universal, by saying it would refuse to show first-run films in English or Spanish at its AMC Dunvale theater if the studios licensed the first-run films in Spanish to Viva Cinema. Viva Cinema alleges AMC's threats were successful and caused the theater to go out of business in November 2013. The suit also alleges that AMC began showing films in Spanish or with Spanish subtitles during matinees, but once Viva Cinema ceased operations, AMC 'went back to its prior practices of exhibiting no, or virtually no, Spanish language films'. It further alleges that not only was AMC's conduct anti-competitive, it was harmful to Houston's Hispanic community.
