Gregory Holenda Announces Bad Faith Claims Against Infinity Select Insurance Co

The U.S. District Court for the Central District of California held an insurer was entitled to summary judgment as to an insured's breach of contract and bad faith claims stemming from an insurance coverage dispute, even though an arbitrator ruled in favor of the insured. Gregory Holenda was insured under an Infinity Select Insurance Co. auto policy, which provided uninsured motorist (UM) coverage of $50,000 per accident and medical payment (med-pay) benefits of $5,000. According to Holenda, in June 2009, he was at a gas station and another vehicle ran over his foot. In August 2009, Holenda's attorney, William Zuber, reported the accident to Infinity Select. Infinity Select paid the $5,000 med-pay limit, but denied Zuber's demand to pay the $50,000 UM policy limit. Infinity Select believed the value of the claim was about $25,000. Infinity Select already paid $5,000 in med-pay coverage and, therefore, on Apr. 27, 2011, it offered $20,000 in "new money" to settle Holenda's claim. Holenda rejected Infinity Select's settlement offer and the case proceeded to arbitration. The arbitrator found Holenda was entitled to general damages for pain and suffering of $57,842. Thus, he awarded Holenda the UM policy limit of $50,000. Infinity Select paid the $50,000 limit. Holenda then sued Infinity Select alleging breach of contract and breach of the implied covenant of good faith and fair dealing. Infinity Select moved for summary judgment. The district court granted Infinity Select's motion. Because Infinity Select paid the full amount of the arbitration award and the UM policy limit, it could not be liable for breach of contract. Moreover, genuine disputes over general and special damages as well as a disagreement among experts barred Holenda's bad faith claim.
