SCL Files Suit in U.S. District Court against Blue Cross and Blue Shield Association
Sep 8 15
A disagreement about the use of the color blue in a logo by SCL Health has landed in federal court. The issue is SCL's use of a half-blue, half-green cross as its logo. SCL has filed suit in U.S. District Court against Blue Cross and Blue Shield Association, asking the court to determine that its logo does not infringe on Blue Cross' trademark, which is a blue cross. SCL revised its logo last year, adding a splash of blue to one side of the symbol, which used to feature an all-green cross. Blue Cross' logo has been blue for decades. According to the SCL suit, Blue Cross and Blue Shield previously threatened legal action and to stop having commercial dealings with SCL. To the untrained eye, there are some key differences between the two cross symbols: SCL's cross has white stripes and a heart in the middle, while Blue Cross features what looks like a spread-eagled human figure.
