BioTelemetry Wins Patent Enforcement Contempt of Court Battle with MedTel24

BioTelemetry announced that a Pennsylvania judge has issued an order finding MedTel24 in contempt of a previous consent judgement issued by the court. The previously issued consent judgment declared five asserted BioTelemetry patents valid, enforceable and infringed by MedTel. The judgment also declared that MedTel is permanently enjoined from further infringement and is required to deliver to BioTelemetry all software, source code, hardware, and documentation relating to the Heartrak ECAT system. The judge ordered that MedTel's CEO is required to submit a declaration to the court that all of the materials have been returned to BioTelemetry within a 21-day window. To ensure MedTel's compliance, the order also provided for a fine of $20,000 per day for each day beyond the 21 days that MedTel fails to deliver the materials as directed. The court will issue a separate order addressing MedTel's other potential violations of the consent judgment and BioTelemetry's requests for lost profits, expenses, attorneys' fees and sanctions.

BioTelemetry Announces Successful Patent Defense against MedTel24

BioTelemetry (BEAT) reported that a U.S. Judge denied a motion filed by MedTel24 and upheld a prior January 2014 decision which states that MedTel24 infringed on BioTelemetry patents relating to its heart monitoring software. BioTelemetry noted that its subsidiary CardioNet filed a lawsuit against MedTel24 in 2012. The company will continue to 'vigorously protect' its patents, 'including taking action against any parties that employ products without consent'.
