Akerman and Attorneys Settles $4.6 Million Lawsuit with Federal Deposit Insurance Corp

Akerman Senterfitt and two attorneys settled a lawsuit with the Federal Deposit Insurance Corp. (FDIC) over the handling of a $7 million loan for the now-shuttered Peninsula Bank. The FDIC sought to recover damages in excess of $4.6 million. Akerman and the attorneys deny liability in the suit, but settled with the regulator for $250,000 to avoid uncertainty and further litigation expenses. The lawsuit was the result of a $7 million loan Peninsula Bank hired Akerman and the two attorneys to represent the bank's interest in, according to a complaint filed in June 2013. The loan was made to North Bay Village Investment Trust LLC for the purpose of developing a condo in North Bay Village. The investment trust pledged certain real estate as collateral for the loan, but when the trust defaulted on the loan in 2009, Peninsula wasn't able to foreclose on the property. The complaint alleges that Akerman and the attorneys were negligent in securing the bank's interest in the loan.

Akerman Announces Appointment of Partners

Akerman LLP announced that five litigators, including prominent trial lawyers Douglas Albritton, Martin Tully and Dara Tarkowski, as well as Lauren Cooper and Julian Dayal, have joined the firm's rapidly growing Chicago office. Bringing its headcount to 24 lawyers, Akerman has tripled the size of the Chicago team since opening the office just six months ago. Albritton arrives as a partner from Reed Smith LLP. Tully joins as a partner from Katten Muchin Rosenman LLP, where he served as national chair of the Electronic Discovery & Information Governance Practice. Also from Katten, Tarkowski joins as a partner, along with staff attorney Cooper and associate Dayal. Albritton has nearly 20 years of commercial litigation and arbitration experience representing both plaintiffs and defendants throughout the U.S. in trial and appellate matters. He represents investors, software companies, private equity and venture capital firms (and their portfolio companies), and a diverse range of other businesses in disputes ranging from the common to the esoteric. Tully is a veteran trial lawyer with more than two decades of experience representing domestic and multinational companies in complex commercial litigation matters. Tarkowski focuses her practice on complex litigation and consumer finance law, representing clients in the debt buying and debt collection industry in multiple regulatory and litigation areas. Cooper brings experience in the debt buyer and debt collection industry, particularly in issues involving compliance with the Fair Debt Collection Practices Act and Fair Credit Reporting Act, as well as various other federal and state regulations. Dayal is a business litigator who focuses on consumer class action defense, commercial arbitration law and white collar and government investigations.
