Fox Rothschild Loses Key Ruling in Suit with Host Hotels & Resorts

Host sued Fox Rothschild LLP in Montgomery County Circuit Court for allegedly aiding Molinaro Koger and its president, Robert Koger, in a trio of what it calls 'sham' transactions. In two separate deals, Host claims Fox Rothschild helped Molinaro Koger set up shell companies that bought three hotels from Host and then sold them for millions more. In a third transaction, the brokerage allegedly set up a shell company to buy the debt on several European hotels Host wanted to acquire and then sold the notes to Host at an inflated price. Circuit Court Judge Ronald Rubin, in a May 13, 2014 ruling, rejected a motion by Fox Rothschild to dismiss the charges, allowing the case to move into the discovery phase. Host General Counsel Elizabeth Abdoo said Rubin's ruling sends a message that law firms will be held accountable for representing clients that commit fraud.
