Canada Top Court Won’t Hear Tobacco Firm Appeal of Ontario Law

Dec. 19 (Bloomberg) -- Canada’s Supreme Court said today it won’t hear appeals by six foreign tobacco companies that had argued Ontario doesn’t have jurisdiction to claim health-care costs from them. Lower courts had ruled the province does have the right to claim costs from the companies including British American Tobacco Plc and R.J. Reynolds Tobacco Co. for treating tobacco-related illnesses.

The companies challenged Ontario’s right to enforce the Tobacco Damages and Health Care Costs Recovery Act.

Also named as applicants in the court documents are R.J. Reynolds Tobacco International Inc., Carreras Rothmans Ltd., British American Tobacco (Investments) Ltd. and B.A.T. Industries Plc. The case is number 35497.
