Settlement Reached in Honeywell Lawsuit
Individuals and Businesses Could Get Money

DOVER, N.H., Feb. 26, 2014 /PRNewswire-USNewswire/ -- The following is being
released by the law firm of Shaheen & Gordon.
An $8.15 million Settlement, inclusive of costs, was reached in a class action
lawsuit with Honeywell International Inc. involving its circular
thermostats.The lawsuit claims that Honeywell used deception to obtain the
trademark for its round thermostat, then used its dominant position in the
market to overcharge customers. Honeywell denies that it did anything wrong,
and there has been no finding by the Court of wrongdoing.
The Settlement includes individuals and businesses that:
oAre residents of Vermont;
oPurchased Honeywell round thermostats ("HRT") in Vermont at any time from
June 30, 1986 until October 31, 2011;
oFor their own use and not for resale.
Vermont consumers who purchased a new home with a pre-installed HRT directly
from the builder are included if they still own the home. Purchases made
directly from Honeywell are not included.
The $8.15 million Settlement Fund will be divided based upon sales of
Honeywell Round Thermostats in Vermont and California. Vermont claimants will
receive 8.2% of the Settlement after fees and costs.
Individuals and businesses that file valid claims can get up to $18 per
thermostat. Individuals and businesses must submit a claim form online or by
mail postmarked by July 18, 2014 to get a payment.
Individuals and businesses may not exclude themselves from this Settlement.
Individuals and businesses may object or comment on the Settlement by April
The Court will hold a hearing on May 16, 2014 to consider whether to approve
the Settlement, a request for attorneys' fees up to 37.5% of the Settlement
Fund, plus reimbursement of costs and expenses.Lawyers have been appointed to
represent individuals and businesses in this case. Any individuals and
businesses may hire their own lawyer to appear in Court and speak at the
hearing at their own expense.
