Windward’s lawyers, CMS Cameron McKenna, have informed Bloomberg that steps 
were taken following the hearing in early November last year which obviated the 
need for the appointment of a receiver, and no receiver was in fact appointed. 
Bloomberg asked CMS whether litigation had been issued in respect of the 
relevant claims which BAT had been seeking to protect, or whether tolling 
arrangements had been put in place, but the CMS spokesman said that he was not 
authorised to comment further.
