Uni-Pixel’s Chief Executive Officer, Reed Killion, had resigned. This news
came shortly after the Company’s November 22, 2013 announcement that the
Securities and Exchange Commission (“SEC”) had issued subpoenas related to
Uni-Pixel’s InTouch Sensors Technology. On news of the SEC subpoenas, shares
of Uni-Pixel dropped by approximately 22 percent. These events led to the

action lawsuit being filed, Uni-Pixel stock traded as high as $41.00 per
