Anapol Schwartz Files da Vinci Robot Surgery Complaint
PHILADELPHIA, PA -- (Marketwired) -- 11/13/13 -- The Anapol Schwartz
personal injury law firm has filed a civil complaint against Cooper
University Hospital, Intuitive Surgical Inc. and David P. Warshal,
M.D on behalf of a 46-year-old woman who died three days after
undergoing a da Vinci robotic total hysterectomy.
The recently filed lawsuit alleges claims of negligence against the
defendant doctor who operated the da Vinci robotic device and
corporate negligence against the hospital. The lawsuit also alleges
that defendant Intuitive Inc. failed to provide adequate warnings
about the use of their robotic device, failed to provide adequate and
accurate training to healthcare providers and physicians, and
promoted their robot to consumers, including Mrs. Farkas, for use in
hysterectomy procedures when safer and more effective methods of
treatment were available.
Georgeann Farkas was a wife and mother of three young children.
During the course of the procedure, the da Vinci robotic device
created four incisions through her intestine. Due to the multiple
incisions in her intestine, Mrs. Farkas' bowel began to leak into her
abdominal cavity causing severe necrosis of her intestine, colon and
abdomen. An exploratory laparotomy revealed that dead tissue had
completely overtaken her colon leading to advanced sepsis and
ultimately the removal of her entire colon. After several
unsuccessful attempts to save her life, Mrs. Farkas died two days
later after suffering from sepsis and severe respiratory distress
following the original surgery. She left behind her husband and three
