ZKB Law to Pursue Individual Lipitor Lawsuits after Judge Denies MDL Status

ZKB Law to Pursue Individual Lipitor Lawsuits after Judge Denies MDL Status

Business Wire

TOLEDO, Ohio -- August 19, 2013

After a judge denied a potential MDL status for Lipitor lawsuits, the class
action attorneys of Zoll, Kranz & Borgess LLC will continue to pursue justice
on a case-by-case basis. Lipitor, marketed by Pfizer, is a drug intended to
treat high cholesterol and triglycerides. Reports suggest that the drug causes
some women to develop Type 2 diabetes, a chronic condition that could turn
deadly without proper treatment.

Through multidistrict litigation (MDL), multiple victims harmed by the same
entity can have their lawsuits consolidated to expedite discovery or the
gathering of evidence. However, just because MDL status was denied at this
time does not mean the lawsuits cannot move forward. Pamela A. Borgess, a
partner at Zoll, Kranz & Borgess LLC, will be pursuing legal action on an
individual plaintiff basis.

“Patients deserve accurate and complete information on the safety of their
medication. The bottom line is, when a drug company hides or minimizes the
dangers of a drug or overstates its benefits to increase corporate profits at
the expense of the patient, the drug company should be held responsible,”
Borgess said. “That’s why we will keep moving forward with Lipitor cases. We
strongly believe that these women now suffering with diabetes deserve their
day in court.”

Women who developed type 2 diabetes while taking Lipitor are encouraged to
contact the attorneys of Zoll, Kranz and Borgess (ZKB) to schedule a free
consultation.

Since 1988, ZKB attorneys have been strong allies for individuals harmed by
dangerous pharmaceutical products. They were the first American firm to file
suit against the makers of Heparin, a drug that was contaminated and connected
to the deaths of hundreds of innocent people. They were heavily involved in
litigation against the makers of Vioxx, they filed suits against DePuy for
faulty hip replacements and they recovered millions for women injured by birth
control medications like Ocella, Yaz and Yasmin. With a licensed medical
doctor on staff, ZKB is strongly positioned to take on companies that have not
acted responsibly and have harmed their clients.
