April 3 (Bloomberg) -- Jerome Kerviel, blamed by Societe Generale SA for its record 4.9 billion-euro ($7.84 billion) trading loss, isn't suing the French bank over his firing, his spokesman Christophe Reille said.

Kerviel hasn't been paid a salary by the bank since January when it uncovered his 50 billion euros in unauthorized positions, Reille said. The trader got a letter while he was in Paris's Sante prison in February from Societe Generale, France's second-largest bank, saying it intended to fire him, he said.

Under French law, a firing requires a face-to-face meeting between the employee and his employer. Kerviel is banned from contact with the bank's management by a court order. His lawyers have written to the bank to say their attempt to fire him breaches French labor laws, Reille said.

``No lawsuit has been filed as of today,'' said Reille. ``We can't say that we'll never file a suit.''

Societe Generale lawyer Jean Veil confirmed the bank wrote Kerviel to inform him it had ``started dismissal proceedings.'' The London-based Times reported earlier that Kerviel plans to sue the bank for unfair dismissal.

Kerviel was released from jail March 18 after a Paris court ruled there was no longer any risk of him tampering with evidence. He'd spent five weeks in what's called provisional detention while magistrates investigated him for fraud, abuse of confidence, and computer hacking. Their investigation isn't completed.

Kerviel has admitted to taking unauthorized trading positions. He says his superiors were aware and had turned a blind eye, something the bank denies. The bank says it incurred the trading loss unwinding those positions after discovering them in late January.
